Welcome to FitMotivate, a fitness matchmaking application developed and operated by Y Tech Solutions LLC, a registered company in the State of Wyoming, USA ("Company", "we", "our").

FitMotivate helps users find fitness partners and stay motivated by connecting individuals based on their goals, training styles, and availability.

These Terms govern your access to and use of our mobile application ("App") and website at https://fitmotivate.me ("Site").

Overview

Acceptance of Terms
 

By downloading, registering, or using the App or Site, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the app or site.

 

  Eligibility

To use FitMotivate, you must:

  • Be at least 18 years old;

  • Be capable of entering into a legally binding contract;

  • Agree to provide accurate, current, and complete information during registration.

    User Accounts and Conduct
     

  • You are responsible for maintaining the confidentiality of your account credentials and are solely responsible for all activities under your account.

  • You agree not to:

  • Use false information or impersonate others;

  • Harass, abuse, or harm other users;

  • Upload or distribute offensive, harmful, or misleading content;

  • Attempt to gain unauthorized access to the App or its backend.

  • Violation of these rules may result in account suspension or termination.


    Subscription Plans
     

  • FitMotivate offers two types of access:

  • Free Plan: Basic features including limited swipes and access to matchmaking tools.

  • Premium Plan: Includes advanced features such as:

  • Unlimited partner swiping

  • Ability to see who liked your profile

  • Send messages to users without a match

  • Priority visibility in match suggestions

  • Premium plans are offered as monthly, 3-month, and 6-month subscriptions via the Apple App Store or Google Play. Subscriptions auto-renew unless canceled before the renewal date. No refunds are offered for unused time.

    Content Ownership & License
     

  • All content, branding, features, and materials on the App and Site are the intellectual property of Y Tech Solutions LLC. You may not copy, distribute, or misuse any materials without express written permission.

  • By uploading content (e.g., photos, fitness preferences), you grant us a non-exclusive, royalty-free license to use, display, and store that content within the platform.


    Location & “Crossed Paths” Feature
     

  • If enabled, FitMotivate may use your location to notify you when you've crossed paths with another user nearby. This feature can be disabled in your device settings. Location data is used solely for matchmaking and in-app engagement purposes.

    Disclaimers
     

  • FitMotivate is a community-driven tool to connect fitness enthusiasts. It does not provide health, nutritional, or training advice. Always consult a certified health professional before starting any new exercise routine.

  • The company does not verify or screen user identities or guarantee the accuracy of user-submitted data.


    Limitation of Liability
     

  • To the fullest extent permitted by law, Y Tech Solutions LLC is not liable for:

  • Any direct, indirect, or incidental damages

  • Loss of data, profits, or user interactions

  • Disputes between users or third-party service failures

  • If liability is imposed, it is limited to the amount you paid to us in the last six months.

    Account Termination
     

  • We reserve the right to suspend or permanently terminate your account if:

  • You violate these Terms;

  • You engage in unlawful, harmful, or fraudulent activity;

  • We choose to discontinue the service (with notice).

  • Upon termination, access to your data and account will cease immediately.

    Governing Law
     

  • These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict of laws rules. Any disputes shall be resolved in the courts of Wyoming.
